HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:35092 OF 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to direct respondents Nos.2 and 3 to amend the relevant terms of Sale Memo dated 9.9.2016 after giving an opportunity to the petitioner for paying sale consideration of Rs.18,78,030/- in equal monthly instalments for executing conveyance deed with respect to Plot No.7 admeasuring 56.91 sq. yards situated at Afzalgunj, Hyderabad.

It is the case of the petitioner that he has been in possession and enjoyment of the premises bearing Plot No.7 from the year 1997 having inherited the same from his father, who was in possession and enjoyment of the same from the year 1957 to 1997 as a tenant. While so, respondents Nos.2 and 3 filed cases for eviction. The petitioner asked the authorities concerned to drop the eviction proceedings by giving an opportunity to him to pay the sale consideration in respect of the said premises. The 3rd respondent issued sale memo dated 9.9.2016 demanding the petitioner to pay Rs.18,78,030/- towards cost of the said premises in lump sum within 30 days from the date of receipt of the said memo. Then, the petitioner made a representation dated 29.9.2016 requesting the respondents to grant permission for payment of sale consideration in 12 equal monthly instalments. But the respondents have not responded.

Heard and perused the material available on record.

Considering the circumstances of the case and the grievance of the petitioner, this Writ Petition is disposed of with the following directions: "The respondents are directed to dispose of the representation of the petitioner dated 29.9.2016 within a period of three months from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
