Petitioners complain against seizing Tractors and Trailers bearing Nos.AP 15 TC 7645 and AP 15 TC 7644 and TS 02 GTR 1706 and TS 03 FTR 7165 as illegal and unconstitutional and seeks release of the vehicles in terms of G.O.Ms.No.3 Industries & Commerce (Mines-I) Department dated 08.01.2015 and G.O.Ms.No.15 Industries and Commerce (Mines-I) Department dated 19.02.2015. 2.
On instructions, the Assistant Government Pleader for Home, submits that, on 21.10.2016, in Cr.No.167 of 2016 the subject vehicles have been deposited before the Court of II Additional Judicial First Class Magistrate, Huzurabad. Since the vehicles are deposited with the Court of competent jurisdiction, the petitioner has to move the Court for appropriate reliefs.
By granting liberty to file application for release of vehicles, the writ petition is disposed of. Since policy decision is taken in G.O.Ms.No.3 dated 08.01.2015 and G.O.Ms.No.15 dated 19.02.2015 for release of vehicles, the petitioners are given liberty to bring the same to the notice of the Court when their application is considered for release of vehicles.
