Mrs.Sara Begum v. The State Of Telangana
THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14545 of 2015 ORDER:
This writ petition is filed for writ of Mandamus declaring the action of the respondents more particularly respondent No.4-Mandal Revenue Officer, Uppal Mandal, Ranga Reddy District, in disconnecting power supply to the petitioner's bore-well situated in an extent of 0.10 guntas in Sy.No.148 of Uppal Bhagyath Mandal, Ranga Reddy District, without following due process of law, as arbitrary and illegal, and for a consequential direction to the respondents not to interfere with the petitioner's use and enjoyment of the bore-well. Heard both sides.
Admittedly, the petitioner did not obtain permission to dig the bore-well. However, she made an application on 29.04.2015 to the 4th respondent for grant of permission and paid the requisite fee and that the said application is still pending. Hence, an appropriate decision has to be taken thereon by the 4th respondent. Accordingly, the writ petition is disposed of directing the 4th respondent to take appropriate decision on the representation dated 29.04.2015 submitted by the petitioner, within a period of two weeks from the date of receipt of a copy of this order. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed. ______________________ JUSTICE K.C.BHANU 14th May, 2015 IBL/VV
