THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 40361 of 2016 ORDER: (Per VRS,J) Aggrieved by a conditional order of stay granted by the Debts Recovery Tribunal, the petitioners have come up with the above writ petition.

All that the Tribunal has done is to direct the petitioners to make payment of 30% of the liability, in two installments. We do not think that any interference with the said order is warranted. If the petitioners want extension of time to comply with the order, it is open to them to move the Tribunal. In case the Tribunal accepts the extension of time, even if the auction is held today, the same can always be set at naught by the Tribunal.

With the above observations, the Writ Petition is disposed of. Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G. SHYAM PRASAD, J 22nd November, 2016 cbs
