HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION NO. 42799 OF 2016 ORDER:

This Writ Petition has been filed by the petitioner challenging the order dated 5.11.2016 issued by the second respondent placing the petitioner under suspension pending enquiry.

It is not the case of the petitioner that the second respondent has no jurisdiction to place him under suspension pending enquiry into certain allegations against petitioner.

Though counsel for the petitioner states that the petitioner is innocent and has not committed any misconduct as alleged by the second respondent, I am not inclined to go into the merits of the case since the show cause notice dated 11.12.2016 has been given to the petitioner by the second respondent to submit explanation.

Therefore, the Writ Petition is disposed of directing the second respondent to consider the explanation to be submitted by the petitioner to the said show cause notice dated 11.12.2016, conduct such enquiry as warranted by law and then pass a reasoned order and communicate his decision to the petitioner. This exercise shall be completed within four months from the date of receipt of a copy of this order. There shall be no

order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
