HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.Nos.26526, 6955, 6949 & 6999 of 2016 COMMON ORDER All these four writ petitions are being disposed of by this common order as they relate to regularization of services of Associate Professors in the Department of Chemistry, Business Management Assistant Professor in the Department of Computer Science in Mahatma Gandhi University, Anneparthy, Yellareddigudem Post, Nalgonda District.

The respondent-University was established in the year 2007. Initially the teaching staff from different Universities were posted for teaching purpose.

Subsequently, on 15.09.2011, University issued a notification inviting applications for the posts of Professors, Associate Professors Assistant Professors in fields Sciences, Management, Arts, Computer Science and Informatics.

applications were received by the University for all the posts interviews were conducted in

accordance with the University Grants Commission (UGC) Rules and Regulations.

The selection committee selected candidates as per required qualifications subsequently, Monitoring & Development Committee of Mahatma Gandhi University approved the appointments of the teaching staff in three phases i.e., by its 30th meeting held on 27.3.2012, 33rd meeting on 12.10.2012 and 34th meeting held on 26.11.2012 respectively.

Accordingly, the selected candidates joined in the services of the University. All the 32 faculty members have successfully completed their probation of two years in service. As per norms regulations University it is inevitable that University declares their probation on the date on which the respective candidates have completed their two years of service in the University with all consequential benefits including the promotions. When the said action was not taken, all these writ petitions were filed.

When these writ petitions are taken up for consideration, learned Standing Counsel appearing for the respondentUniversity submitted that in view of completion of probation of 32 faculty members, their services have to be regularized by declaring their probation and they are entitled to all consequential benefits.

In view of the submission of the learned Standing Counsel, no further adjudication is necessary in all these writ petitions as the University itself has admitted that petitioners have completed two years prescribed period of probation they are entitled to declaration of their probation.

Accordingly, all the writ petitions are allowed and the respondents are directed to declare probation petitioners, who completed the prescribed period of probation, in accordance with the rules, and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No

costs.

Miscellaneous petitions, if any, pending shall stand closed.
