ORDER:

The petitioner claims to be the owner of site to an extent of 1293.28 square yards in Survey No.127 of Pendurthi Village and Mandal within the limits of the Greater Visakhapatnam Municipal Corporation. According to the petitioner, some unauthorized persons have encroached into the land of the petitioner with a mala fide intention to grab the property of the petitioner, colluded with daughters of one of the vendors of the petitioner, created fraudulent and false documents and applied for building permission on 20.02.2015. The said building permissions were earlier returned. A notice was issued on 16.03.2015 under Section 452 of the Greater Hyderabad Municipal Corporation Act, 1955 (for short, 'the Act') against illegal constructions in the aforesaid property without obtaining any valid building permission.

Having come to know about the above developments, the petitioner made representations to the 2nd respondent Municipal Corporation on 03.05.2015, 12.05.2015 and 17.06.2015 praying to take further action in accordance with Section 669 of the Act. Alleging that so far, no decision is taken on the representations submitted by the petitioner, this writ petition is filed.

2. When the matter is taken up for consideration, learned counsel for the petitioner as well as the learned Standing Counsel representing the 2nd respondent Municipal

Corporation agreed for disposal of the writ petition with a direction to the 2nd respondent Municipal Corporation to pass orders on the representations submitted by the petitioner, dated 03.05.2015, 12.05.2015 and 17.06.2015.

3. Having regard to the said submissions, the Writ Petition is disposed of, without expressing any opinion on merits, directing the 2nd respondent Municipal Corporation to pass orders on the representations submitted by the petitioner, dated 03.05.2015, 12.05.2015 and 17.06.2015, within a period of four (4) weeks from the date of receipt of a copy of this order.
