THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10357 OF 2018 ORDER:

This criminal petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") questioning the docket order dated 08.08.2018 passed in C.C.No.181 of 2018 by the Judicial Magistrate of First Class, Puttur, whereby the petitioner herein was directed to furnish self bond of Rs.5,00,000/- with one surety. Respondent No.2 herein filed private compliant for the offence punishable under Section 138 of Negotiable Instruments Act against the petitioner herein. On appearance of the petitioner, after furnishing documents, the Magistrate concerned directed the petitioner herein to execute self bond of Rs.5,00,000/- with one surety by 04.09.2018.

The total amount covered by dishonored cheque is Rs.14,00,000/-, whereas the Court insisted for execution of self bond of Rs.5,00,000/- with one surety for ensuring appearance of the petitioner on the dates of adjournments during trial. During hearing, learned counsel for the petitioner requested this Court to reduce the self bond amount.

Acceding to the request of the learned counsel for the petitioner, the self bond amount is reduced to Rs.3,00,000/- (Rupees Three lakhs only) from Rs.5,00,000/- (Rupees Five lakhs only). Accordingly, the petitioner herein is directed to execute self bond for Rs.3,00,000/- (Rupees Three Lakhs only) within one week from today.

MSM,J Crl.P_10357_2018 With the above direction, the criminal petition is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
