This Criminal Petition is filed for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1 and 2 in FIR.No.1282 of 2025 before the Kukatpally Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 338, 336(3), 340(2), 318(4) and 61(2) of BNS.

The brief facts of the case are that on 01.10.2025 a petition was received from the City Planner, Kukatpally Zone, GHMC, alleging that M/s.JSVR Projects LLP had applied for an Occupancy Certificate but the said application was rejected due to major deviations such as

non-maintenance of mandatory setbacks and tot-lot area. It was further alleged that despite not submitting any requisition for release of the mortgaged area, a reconveyance/release deed bearing Document No.7396/2025 dated 27.09.2025 was executed at the SRO, Kukatpally by one Mohd. Naseer, a subordinate employee in the Town Planning Section, without the knowledge of the Department. Upon verification, the Officials found that the authorization letter and signatures on the said deed were fabricated and forged.

Heard Sri G. Venkat Ratnam Goud, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioners submitted that the petitioners had no role, direct or indirect, in the alleged forgery or fabrication, and that the entire complaint was based on suspicion without there being any specific accusation or evidence against the petitioners. He asserted that even as per the own narrative of complainant, the forged documents were created and the reconveyance deed was executed by the subordinate staff of the GHMC, and that the petitioners neither obtained, nor submitted any authorization letter to the SRO. He averred that the case is entirely based on documentary evidence which is already in the custody of the authorities. Therefore, he prayed the

Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. He contended that as the investigation was not yet completed, the question of granting anticipatory bail to petitioners, does not arise at this stage. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made, and on going through the material placed on record, it is noted that in the complaint there is no clarity regarding specific allegations leveled against the petitioners with regard to forgery of documents. However, considering the fact that the investigation is based on documentary evidence, this Court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions :

i.

The petitioners shall surrender before the Station House Officer, Kukatpally Police Station, Medchal Malkajgiri District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on them executing a personal bond for Rs.25,000/- each

(Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required. iii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.
