HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.10393 of 2010 AND CRL.P.M.P.No.1343 of 2016 ORDER:

Petitioner-A3 has filed this petition seeking quashing of the proceedings initiated against her in Crime No.30 of 2010 on the file of the Central Crime Station, Hyderabad, registered for the offences punishable under Sections 498-A, 420, 406, 323, 506 read with Section 34 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act.

The 2nd respondent herein filed a private complaint against the petitioner herein and three others for the aforesaid offences before the XIII Additional Chief Metropolitan Magistrate, Hyderabad, which was referred to the police under Section 156 (3) Cr.P.C. for investigation and report. Thereafter, the Sub Inspector of Police, Women Police Station, Central Crime Station, Hyderabad, registered the complaint against the accused as a case in Crime No.30 of 2010 under the aforesaid offences and took up investigation.

When this matter is taken up for hearing, it is brought to the notice of this Court by the learned Counsel for the petitioner as well as the learned Counsel for the 2nd respondent- de facto complainant that the parties have compromised the dispute and settled the matter out of Court and the same was reduced into writing at the instance of elders and to that effect they filed a joint compromise memo.

The said joint compromise memo, which is signed by the parties and their Counsel, is accompanied by a petition i.e.,

Crl.P.M.P.No.1343 of 2016. Today, one Mohd. Abdul Layeeq (A1), G.P.A. holder of petitioner-A3, and the 2nd respondent-de facto complainant were present before this Court and they were identified by their respective Counsel. This Court when examined the 2nd respondent-de facto complainant, she stated that she has settled the disputes with the petitioner and she no objection to quash the proceedings initiated against the petitioner herein. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and Crl.P.M.P.No.1343 of 2016 is ordered. Accordingly, the Criminal Petition is allowed and the proceedings initiated against the petitioner-A3 in Crime No.30 of 2010 on the file of the Central Crime Station, Hyderabad are hereby quashed in terms of the compromise entered into between the parties.
