HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU A.S.No.2360 of 1998 JUDGMENT:

The matter was listed today to hear the learned counsel for the appellant on the question whether the appeal survives or not.

The learned counsel for the respondent submits that the sole respondent died on 16.06.2004. This fact was intimated to the Court by filing a Memo in October 2010 itself along with details of legal representatives. Till date, no steps have been taken.

Hence, the appeal is dismissed as abated against the respondent. However, there shall be no order as to costs. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
