THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 6159 of 2016 ORDER:

Heard Ms. V. Sesha Kumari, learned counsel for the petitioner Association, and Sri V. Narasimha Goud, learned Standing Counsel for the Hyderabad Metropolitan Development Authority, second respondent.

2. This writ petition is filed by the Mahmood Nagar Welfare Association with the following prayer: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus, or any other appropriate writ, order declaring the action of the respondent No.2 in trying to interfere with possession of petitioner association members and trying to dispossess the petitioner members from the land in Survey No.25/1 and 25/2 situated at Kompally Village, Qutubullapur Mandal, Ranga Reddy District without following due process of law as is illegal, arbitrary and in violation of Articles 14, 21 and 300-A of the Constitution of India, consequently direct the Respondents 1 & 2 not to dispossess the Petitioner Association Members pending disposal of their representations dated 27-10-2007, 06-06-2010, 16-07-2010 following due process of law in the interest of justice and pass such other order or orders as deemed fit and proper in the circumstances."

3. No details have been placed on record either as to registration of the petitioner Association or the identity of its members. That being so, the Association cannot espouse the cause of unknown members in relation to the

alleged threat of dispossession from the authorities.

4. The writ petition is accordingly dismissed on this short ground.

This order shall however not preclude the members of the petitioner Association from individually filing separate cases in accordance with law.
