THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.4550 OF 2017 ORDER:
This Civil Revision Petition is filed under Article 227 of the Constitution of India aggrieved by the order dated 20.07.2017 passed in I.A.No.1120 of 2016 in HMOP No.123 of 2015 on the file of the Court of the Senior Civil Judge, Ramachandrapuram, East Godavari District. At the time of arguments, the learned counsel for the respondent submitted that the documents in question were marked already. A perusal of the proceeding sheet of this Court dated 22.12.2017 also clearly indicates that the documents in question were already marked. The present revision petition is filed challenging the order passed in I.A.No.1120 of 2016, filed under Order VII Rule 14 (3) of CPC, to receive certain documents. A perusal of the record reveals that the trial Court allowed the said petition and received the documents in question.
In view of the marking of the documents by the trial court, no further orders need be passed in this Civil Revision Petition. Accordingly the Civil Revision Petition is disposed of. No order as to costs. However, disposal of the Civil Revision Petition does not preclude the petitioner herein to challenge the validity or otherwise of the documents in question, in the light of the provisions of the Indian Evidence Act. As a sequel, miscellaneous petitions, if any, pending in this revision petition shall stand closed.
