ORDER:
This Company Application is filed for a direction to the respondent to deposit a sum of Rs.25,000/- towards initial expenses with the Official Liquidator and to permit the Official Liquidator to reimburse the said amount on priority basis out of the realization.
Though Sri M.Giri, learned counsel for the respondent, had appeared on 10.12.2014 and requested for an adjournment, he has not appeared on
29.12.2014 and also today.
As order, dated 06.08.2014, passed in Company Petition No.163 of 2011 has not cautioned any direction for deposit of any amount towards initial expenses with the Official Liquidator, this Company Application is ordered. The respondent is directed to deposit a sum of Rs.25,000/- with the Official Liquidator within one month from the date of receipt of a copy of this order. The amount so deposited by the respondent shall be reimbursed by the Official Liquidator on priority basis from out of the realization. If the respondent fails to deposit the initial expenses, the order, dated 06.08.2014, in Company Petition No.163 of 2011 will automatically stand withdrawn and the Company Petition itself will stand dismissed.
