HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33389 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in illegally trying to interfere with and disturb the possession of the petitioner from the land admeasuring Ac.0.03 cents with assessment No.239 situated in Sy.No.91/ 2 of Thimmarajupalem Village, Parchur Mandal, Prakasam District, as illegal, arbitrary and violative of principles of natural justice.

2) At the time when the matter is taken up for hearing, the learned Government Pleader for Revenue (AP) placed on record the written instructions, wherein it is mentioned that the patta granted to the petitioner was cancelled in the year 2015 and that the petitioner is not residing in the village and he is residing in Chilakaluripeta Town.

3) The learned counsel for the petitioner would submit that the petitioner is in possession of the property, but the same is strongly disputed by the Government Pleader for Revenue stating that the petitioner is not staying in Timmarajupalem Village.

4) Fact remains that an order came to be passed in the year 2015 cancelling the patta granted to the petitioner, for which he has to avail the remedy available under law. Since the grievance of the petitioner is that the said order is not communicated to him, the respondents shall forthwith communicate the order to the petitioner and take acknowledgement of the same by 21.09.2018 and thereafter, the petitioner, if so advised shall avail the remedy available under law. In view of the claim made by the petitioner that he is in possession of the property even as on today status quo as on today shall be maintained for a period of two (02) weeks, enabling the petitioner to file an appeal before the appropriate authority.

5) With the above direction, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
