SMT JUSTICE T.RAJANI CRIMINAL PETITION No.8729 of 2013 ORDER:

This petition is filed seeking for quash of the proceedings against the petitioners, who are A2 to A5, in Crime No.155 of 2013 on the file of Peddapuram Police Station, East Godavari District. The offences alleged against the petitioners are under Sections 417 and 420 IPC and Section 3 (1) (x) of the SCs & STs (POA) Act.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent.

The Public Prosecutor files a memo stating that the charge sheet is filed only against A1 by deleting the names of A2 to A5 and that the case against A1 underwent trial and he was acquitted vide judgment, dated 19.04.2017, passed by the Special Judge for Trial of Cases under S.Cs & S.Ts (POA) Act ‐ cum - X Additional District & Sessions Judge, East Godavari District at Rajahmundry, in S.C.S.T.S.C.No.130 of 2014. 4.

Hence, in view of the above, no cause of action survives for adjudication and no further orders are necessary. 5.

Accordingly, the criminal petition is dismissed as infructuous. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
