THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21849 OF 2016 ORDER:

Heard the learned counsel for the petitioner; learned Government Pleader for Municipal Administration and Urban Development for respondent No.1; Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondents 2 and 3; learned Government Pleader for Home for respondent No.4. With their consent, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not adjudicating the matter on merits, hearing the unofficial respondents may not be necessary.

3. The present Writ Petition is filed with the following prayer: "to issue a writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the inaction of the Respondents 2 to 4 as illegal and arbitrary as such this Hon'ble court may be pleased to pass appropriate order to consider the representations made by Petitioner dated: 08.01.2016 regarding illegal operation of "Aruna Sree Executive Women's Hostel" in the Residential premises and unauthorised constructions built in parking area and consequently directing the Respondents No.1 to 4 to initiate the action on the representation made by the petitioner dated:08.01.2016 and also to his legal notice issued on 16.04.2016 to Respondent No.2 & 3."

The grievance of the petitioner appears to be that he made a representation on 08.01.2016 and a legal notice on 16.04.2016 making note of illegal operation of Aruna Sree Executive Women's Hostel in the residential premises and unauthorized constructions built in parking area, but no action has been initiated till date.

5. Learned counsel for the Municipality submits that if the said representation is still pending consideration, respondent authorities will pass suitable orders at the earliest.

6. Having regard to the above and without going into the merits of the case, the Writ Petition is disposed of directing the 3rd respondent to dispose of the representation dated 08.01.2016 made by the petitioner, in accordance with, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order. Needless to mention that the said authority shall hear the petitioner and also the unofficial respondents before passing orders thereon.
