THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19907 of 2014 ORDER:

The petitioner is the Upa-Sarpanch of M.Alamanda Village, Devarapalli Mandal, Visakhapatnam District, challenges proceedings, dated 06-07-2014, whereunder the 5th respondent was restored as fair price shop dealer of M.Alamanda Village.

With the assistance of the learned counsel appearing for the parties, I have perused the proceedings, dated 06-07-2014. Prima facie, I am of the view that 3rd respondent on being satisfied with the explanation given by 5th respondent restored the fair price shop to 5th respondent. No exception to such a measure at this stage can be taken muchless pointed out by petitioner. It is needless to observe that in respect of the concession shown by 3rd respondent through proceedings, dated 06-07-2014, if there is no change in the attitude of 5th respondent, liberty is given to petitioner to file written complaint before 3rd respondent and 3rd respondent thereafter initiate action in accordance with the extant procedure and take sth to its logical conclusion. With the above observation, the writ petition is disposed of. No order as to costs.
