HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.33532 OF 2017 ORDER:

This writ petition is filed seeking to declare the action of the respondents for not providing the security to the person and property of the petitioner as illegal and to implement the order dated 21.04.2015 passed by this Court in W.P.No.11481 of 2015 in respect of agricultural land admeasuring Ac.19.20 cents in Sy.Nos.80/1,80/2,70/2,70/3 within the specified boundaries situated at Gondolu Village, Addateegala Mandal, East Godavari District. Today, when the writ petition has come up for hearing, learned Government Pleader for Home (A.P) passed on the written instructions given by the Sub Inspector of Police & S.H.O, Addateegala Police Station, East Godavari District dated 10.10.

2017 stating that the petitioner is not in continuous possession of the land in question and basing on the complaint received from the petitioner a case in Crime No.29 of 2016 dated 8.5.2016 was registered under Sections 447,427, 506 IPC on the file of the 4th respondent police station against one I. Ganga Raju, son of the 5th respondent herein and two others and the same is pending for investigation for want of clarification from the Tahsildar, Addateegala Mandal, East Godavari District. It is further stated that the request of the petitioner to provide police protection to him is unsustainable in view of the orders of the Government issued in G.O.Ms.No.101, Social Welfare (LTR-2) Department dated 01.02.2013 wherein the claim of the mother of the petitioner in respect of the said land was rejected.

Learned counsel for the petitioner submits that the petitioner filed Writ Petition No.11481 of 2015 and this Court on 21.4.2015

granted an interim direction directing the respondents not to evict the petitioner from the land to an extent of Ac.8.00 cents in Sy.Nos.80/1 and 80/2 of Gondulu Village, Addateegala Mandal, East Godavari District, pending disposal of the writ petition. Learned counsel for the petitioner further submits that in spite of the said interim direction, the accused in the Crime No.29 of 2016 on the file of the 4th respondent police station are trying to enter into the land of the petitioner. In that connection petitioner gave a complaint dated 18.07.2017 to the Station House Officer, Addateegala Police Station, East Godavari District and it is pending consideration.

Having regard to the facts and circumstances of the case and especially in view of the fact that the complaint of the petitioner is pending with the 4th respondent Police Station from 18.7.2017, the writ petition is disposed of directing the 4th respondent Police Station to act on the complaint/representation dated 18.07.2017 of the petitioner in accordance with law as expeditiously as possible. No order as to costs.

Consequently, Miscellaneous petitions, if any pending in this writ petition shall also stand closed ________________________________ KONGARA VIJAYA LAKSHMI,J Date:04.01.2018.
