HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.482 of 2015 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Home.
The petitioners allege that they are owners and possessors of various extents of lands in Sy.Nos.242 (p), 246 (p), 247 (p), 249 (p). 250 (p) 251 (p), 252 (p) and 268 (p) of Bowrampet Village, Qutubullapur Mandal, Ranga Reddy District, as per the validation certificates issued by the Mandal Revenue Officer, Qutubullapur Mandal, Ranga Reddy District, under Section 5-A of the A.P. Record of Rights in Land and Pattadar Pass Books Act, 1971. It is stated that the dispute regarding the said validation certificates is a subject matter of W.P.Nos.16554, 16559 and 16563 of 2005 before this Court and an interim order is subsisting thereon. While so, respondents 7 and 8, at the instance of respondents 9 and 10, who are contesting civil litigation, alleged to have pressurizing the petitioners to withdraw the cases pending between the petitioners and respondents 9 and 10 and also repeatedly calling the petitioners and detaining them in the police station.
The instructions received by the learned Government Pleader from the 7th respondent, however, show that one Sri A.Gandhi Reddy, S/o.Koti Reddy, approached the 7th respondent and lodged a complaint on 11-01-2015 alleging that one Chinthala Nagaraju and his followers illegally trespassed into his land and threatened him with dire consequences. Based on the said complaint, a case in Cr.No.16 of 2015 is said to have been registered on 11-01-2015 by the 7th respondent and investigation is taken up. It is stated that the investigation made so far discloses that the involvement of the petitioners is not found nor the petitioners are shown as accused in the above case. It is also stated that prima facie it appears to be a civil
dispute between the petitioners and respondents 9 and 10. It is also stated that the 7th respondent never pressurized the petitioners to withdraw the cases pending between the petitioners and respondents 9 and 10 nor summoned them to the police station as alleged by the petitioners.
In view of the aforesaid instructions, it is evident that the petitioners are neither accused in the said crime nor so far, their involvement is revealed during investigation. The allegation of harassment by the 7th respondent is also denied. In view of that, the writ petition is disposed of directing the 7th respondent to investigate the said crime and take appropriate further steps in accordance with law. So far as the petitioners are concerned, take appropriate action only in the event of involvement of petitioners is being found during investigation. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
