Dharavath Chandu Naik v. The Collector (Panchayat Wing)

HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.22328 of 2012 ORDER:

The petitioner challenges Proceedings Rc.No.P6/514/2012-8 dated 28.05.2012 and FIR No.96 of 2012 on the file of the 4th respondent as illegal, arbitrary and unconstitutional.

The learned Assistant Government Pleader, Home, on written instructions dated 30.01.2017, submits that after investigation, charge sheet was filed in C.C.No.658 of 2013 and the accused are facing trial. He further submits that, with the filing of the charge sheet, the prayer in the instant writ petition is untenable and unavailable. He prays for dismissing the writ petition.

Learned counsel for the petitioner submits that since a charge sheet is already filed, the Court may consider granting liberty to the petitioner to workout remedies in accordance with law against the charge sheet. The statement is placed on record.

Writ petition is disposed of, as no further order is necessary. Pending miscellaneous petitions, if any, shall stand closed. No costs.
