THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38957 OF 2016 ORDER:

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent herein in registering the F.I.R.No.334 of 2016, dated 03-09-2016 under Sections 498-A, 406 and 420 I.P.C. and Sections 3 & 4 of Dowry Prohibition Act on the file of the Rural Police Station, Nizamabad against petitioners and another as arbitrary, illegal and unconstitutional, violating Articles 14, 16(4) and 21 & 300-A of Constitution of India and consequently set aside the said F.I.R.No.334 of 2016, dated 03-09-2016 on the file of Rural Police Station, Nizamabad insofar as petitioners are concerned. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home and perused the material available on record.

Considering the facts and circumstances of the case and taking into consideration the fact that the matter is arising out of matrimonial dispute, the police concerned are directed to complete the investigation without arresting petitioners and file the final report in accordance with law. The petitioners are directed to execute a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only)

each with one surety for a like sum each to the satisfaction of the Investigating Officer for their future appearance as and when required by the investigating agency for the purpose of investigation With the above direction, the Writ Petition is disposed of. No costs.

Consequently, miscellaneous petitions, if any, pending in this Writ petition shall stand closed.
