RESPONDENT COMMON ORDER These Criminal Petitions are filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.4, 5 and 6, respectively, in Crime No.233 of 2025 of Chikkadpally Police Station, Hyderabad, registered for the offences punishable under Section

318(4), 319(2), 111(2)(b) read with 3(5) of BNS and sections 66C and 66D of IT Act.

The brief facts of the case are that on 21.08.2025, a complaint was received from Bagammagari Rajitha, who stated that she had been lured into a part-time online job through Instagram and was directed to perform small tasks and later to invest money through PhonePe. Believing that she would receive returns with interest, she transferred a total of Rs.94,800/- to different bank accounts, after which the accused continued demanding more payments. Realizing it was a scam, she filed a cybercrime report. Based on the subsequent investigation, the petitioners were implicated in the case on the allegation that bank account details were provided to accused No.1.

Heard Sri C. Hari Preeth, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that neither the complaint nor the remand report disclosed any material suggesting the involvement of the petitioners, and the only allegation that was leveled against the petitioners was based on an alleged policerecorded confession, which had no evidentiary value. He further

submitted that the investigation itself confirmed that the fraudulent amounts were routed only through the accounts of accused Nos.2 and 3, and no money was ever transferred to the account of the petitioners. He contended that the petitioners have been in custody since 01.10.2025 despite no overt act being attributed against them. Therefore, while advocating that the investigation concerning the petitioners was substantially completed, he prayed this Court to grant bail to the petitioners by allowing these Criminal Petitions. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. He averred that the investigation is not yet completed and there are number of victims in the hands of the petitioners. Therefore, he prayed the Court to dismiss these criminal petitions.

Having regard to rival submissions made, and on going through the material placed on record, it is noted that the petitioners were remanded to judicial custody on 01.10.2025. Considering the period of incarceration of petitioners, and the fact that LWs.1 to 7, including the investigating Officer, are already examined, this Court deems it fit to grant bail to the petitioners, subject to following the below conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the IV Additional Sessions Judge, at Hyderabad.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.
