HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33471 of 2018 ORDER:
The present writ petition came to be filed questioning the notice issued in the month of August, 2018, directing the petitioners to appear before the Sub Collector and appellate authority on 15.09.2018 at 11 a.m. in Sub Collectors' Office, Vijayawada for enquiry into the petition filed under ROR Act by Smt. Pamulapati Padmavathi, W/ o. Late Hanumantha Rao, R/ o. Velagaleru Village, G.Konduru Mandal, requesting to hand over her land, admeasuring Ac.4.88 Cts., in R.S.No. 261/ 1 of Velagaleru village, which was encroached by Smt.Chanumolu Bharathi (mother of the petitioners), W/ o. Seetharam Prasad, as illegal, improper and incorrect.

The learned counsel for the petitioners mainly submits that having failed in all her attempts to get an order, Smt.Pamulapati Padmavathi approached the Revenue Divisional Officer, suppressing the facts which led to issuance of the impugned notice. The learned counsel would submit that the revenue records also show the right of the petitioners over the lands in question, and that the Civil Court granted injunction in favour of the petitioners.

Since the grievance of the petitioners appears to be that Smt. Pamulapati Padmavathi, having failed in all her attempts, got issued the impugned notice by suppressing the truth, the
petitioners herein shall submit an explanation to the said notice issued by the Revenue Divisional Officer, Vijayawada within a week from today, if no order is already passed by the Revenue Divisional Officer, in which event, the said authority shall give a personal hearing to the petitioners herein and also to all concerned, and then pass orders, in accordance with law, as early as possible, within a period of four to six weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 18.09.2018 DMG
