THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE DR. JUSTICE SHAMEEM AKTHER W.P.NO.20895 OF 2017 O R D E R (Per the Hon'ble Sri Justice Suresh Kumar ) This writ petition is filed for the following relief: "For a writ, order or direction more particularly one in the nature of writ of certiorari calling for the records relating to and connected in O.A.No.940/2016 on the file of the Hon'ble Andhra Pradesh Administrative Tribunal, Hyderabad and to quash or set aside the order dated 20-02-2017 in O.A.No.940/2016 and to pass such other order or orders as this court deemed fit and proper in the circumstances of the case." Vide order dated 20.02.2017 passed in O.A.No.940/2016, the learned Tribunal directed the petitioners 2 and 3 to implement G.O.Ms.No.277 Home (SER-II) Department dated 11.12.2013 and extend the benefits therein to the respondent No.1 herein within a period of three months from the date of the order.

Learned Government Pleader appearing on behalf of the petitioners would submit that pursuant to G.O.Ms.No.277 dated 11.12.2013, show cause notices were issued to all the concerned and the petitioners received their objections and by considering the objections, the Government decided to withdraw G.O.Ms.No.227 dated 11.12.2013 by G.O.Ms.No.98 Home Department dated 13.6.2017.

We note that the learned Tribunal directed to implement G.O.Ms.No.227 and the said G.O. was in existence on the date of passing the order. Thereafter, after taking some steps, the Government though it fit to withdraw, and same has been done by subsequent G.O.Ms.No.98 dated 13.6.2017.

Since the G.O.Ms.No.227 has already been withdrawn, no further order is required to be passed in the present writ petition and the same is accordingly dismissed.

We hereby make it clear that if the respondent is aggrieved by G.O.Ms.No.98 dated 13.6.2017, he may approach the appropriate forum available under law.

No order as to costs.
