THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 12752 OF 2017 O R D E R :

This Writ Petition is filed complaining inaction on the part of the respondents in considering the Application dated 08.12.2016 of the petitioner for prior clearance for grant of bar licence in premises bearing Municipal No. 18-4-42/1 situated at Shamsheer Gunj, Hyderabad.

The petitioner submits that he has been conducting business in the name and style of 'Tirumala Restaurant' in the above-said premises. While so, when the respondents issued a notification in November 2016 inviting applications for issue of prior clearance for issue of bar licence, on 08.12.2016, the petitioner had applied for the same under Rule 5 of Telangana Excise (Grant of Licence of Selling by Bar and Conditions of Licence) Rules, 2005. Pursuant thereto, inspection was carried out by the Excise officials, but thereafter, no action has been taken thereon. He therefore, submitted the representation dated 03.04.2017 to the respondents seeking consideration of his Application dated 08.12.2016, but in vain.

Heard learned counsel for the petitioner.

Learned Government Pleader for Prohibition and Excise, on instructions, submits that the process of selection has not yet been completed and, as on date, no decision has been taken. He, however, submits that the Application of the petitioner will be considered in accordance with law.

Recording the submission of the learned Government Pleader, the Writ Petition is disposed of with a direction to the respondent - authorities to consider the Application of the petitioner dated 08.12.2016 for prior clearance for grant of bar licence. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
