HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33361 OF 2018 ORDER:

The present writ petition came to be filed to declare the action of the respondents in alienating the land of the petitioners situated at Sy.No.102 of Chuttugunta Ramapuram Village Accounts, Ramachnadrapuram Mandal, Chittoor District to the third parties ignoring the pendency of the Revision Petition R.P.No.4/2018 (E1/1343/2016) dated 29.8.2016 of the petitioners before the 2nd respondent as illegal and arbitrary.

The grievance of the petitioners appears to be that when the revision petition in R.P.No.13/2010/CTR/H1, is pending before the 2nd respondent, the officials of the 4th respondent, are trying to survey the subject land with an intention to assign the same to third parties. When the matter is taken up for hearing, learned Government Pleader for Revenue, placed on record the written instructions, received from Tahsildar, Ramachandrapuram, wherein it is stated that the steps are now being taken to subdivide the subject land, so as to enable to assign the same to others.

Learned counsel for the petitioners submits that the petitioners are in possession of the subject land and the action of the officials of the 6th respondent, in trying to assign the subject land to others, when there is a revision pending before the 2nd respondent, is illegal and arbitrary. Learned counsel relied upon the judgment of the Division Bench of this Court reported in Dama Kothilingam @ Kotilingam v. Joint Collector, Prakasham District and another1, to support his contention. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-Commissioner and Director of Survey and Settlement, to dispose of the revision petition in 1 2002 (6) ALD 1 (DB)

R.P.No.13/2010/CTR/H1, filed by the petitioners under Section 5(2) of the Andhra Pradesh (Andhra Area) Estates (Abolition and Conversion into Ryotwari) Act, 1948, as early as possible, preferably, within a period of three months from the date of receipt of copy of this order. Till such time, status quo existing as on today, shall be maintained. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
