THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.905 of 2016 ORDER:

The respondent is present in person.

This contempt case was instituted alleging willful disobedience to the order dated 18.03.2016 passed in W.P.No.9028 of 2016. By the said order, the Nalgonda Municipality, Nalgonda District, was directed to take appropriate action upon the petitioner's representations dated 14.10.2015 and 29.02.2016 with regard to the alleged unauthorized constructions being undertaken by the unofficial respondents. 3.

Sri Praveen Kumar, learned counsel appearing for the respondent, the Municipal Commissioner, Nalgonda Municipality, would inform this Court that letter dated 17.06.2016 was issued by his client to the petitioner informing him that the unofficial respondents had submitted documents and plans sanctioned by the Gram Panchayat and therefore, there was no illegality attaching to the constructions being made by them. The Commissioner further stated that the issue of ownership over the land in question could not be looked into by the municipality and advised the petitioner to approach the competent Court.

In the light of the aforestated communication of the Commissioner, it is clear that there is no disobedience, much less willful disobedience, to the order dated 18.03.2016 passed in W.P.No.9028 of 2016 warranting exercise of contempt jurisdiction.
