THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.2094 of 2015 ORDER:

This Revision is preferred under Article 227 of the Constitution of India, by the Petitioner-husband in divorce petition vide O.P.No.63 of 2007 on the file of the learned Senior Civil Judge, Proddutur, aggrieved by the order and decree dated 11.02.2015 in I.A.No.1607 of 2014 in O.P.No.63 of 2007 filed by the respondent-wife in the said O.P. under Order III Rule 1 of C.P.C. seeking to permit her to conduct her own case in person without gown and band which is allowed by the trial Court.

2. Heard the learned counsel for the petitioner before admission and before issuing notice to the other side and perused the material on record.

3. On perusal of the record, it appears the evidence on both sides is almost at a close and at this stage the learned counsel for the petitionerhusband filed a recall petition of himself as P.W.1 for filing certain documents and to lead further chief examination. The respondent-wife is entitled to cross-examine. Needless to say not confined to the documents but anything among the area of the lis but for a question already covered cannot be repeated.

The grievance is mainly as she filed an application in Crl.P.No.1607 of 2014 to change her advocate and the Court permitted under Order III C.P.C. for her prosecuting the matter directly as a party in person. No doubt, in the order allowing the application since impugned she made certain allegations against the counsel for the divorce petitioner (opposite party) which she cannot without foundation but for to eschew those averments without prejudice to her remedy from the claim in substantiating the above material, the order impugned herein of the trial Court permitting the respondent-wife to prosecute the case personally no way requires interference by this Court.

5. With the above observations, Civil Revision Petition is disposed

of. Consequently, miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
