THE HONB'E SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18916 OF 2012 ORDER:

The writ petition is filed questioning the proceedings dated 16.02.2012, issued by the 4th respondent-Special Deputy Collector as arbitrary and illegal.

When the matter was listed on 28.06.2017, this Court passed a detailed order narrating the facts and also the consensus reached among the parties particularly the petitioner and the contesting respondents (respondents 5 to 7). This Court considering the nature of the issue involved and considering the consent given by both the parties with the course of action suggested by this Court giving a liberty to the respondents 5 to 7 to file an undertaking affidavit agreeing to deposit the amount of compensation which has been paid to them within a time frame. Today, when the matter has come up for hearing, the learned counsel for the respondents 5 to 7 submitted that he has filed an undertaking affidavit under U.S.R.No.

20225 sworn by one Smt Sarswathi Bai, Wife of Dilsukharam, Charminar, Hyderabad representing the other respondents as well giving undertaking to deposit the amount of compensation received excluding the income tax deducted by the Land Acquisition Officer with interest at 8% p.a from the date of their receipt till the date of deposit i.e., at any rate on or before 31.10.2017. The copy of the under taking affidavit has already been served on the learned counsel for the petitioner as well as on the learned Government Pleader for the Land Acquisition.

In that view of the matter, the writ petition is disposed of making the undertaking as part of the record and making it clear that any violations of the undertaking would invite initiation of the

contempt proceedings against the respondents 5 to 7 as the writ petition is being disposed of based on the undertaking given by the respondents 5 to 7 before this Court. The docket order dated 28.06.2017, passed by this Court shall also be annexed to this order. With the above observations, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed. No order as to costs.
