THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11565 OF 2015 ORDER:

1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/accused No.1 in P.R.C.No.62 of 2015 on the file of X Additional Chief Metropolitan Magistrate Court, Secunderabad, including execution of N.B.Ws pending against him.

2 At the time of arguments, the learned counsel for the petitioner has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with a liberty to avail the remedies available to him under law, including filing of petition under Section 70(2) Cr.P.C to recall the NBW pending against the petitioner.

3 Permission is accorded.

4. In the result, the Criminal petition is dismissed, granting the liberty as prayed for. However, the X Additional Chief Metropolitan Magistrate, Secunderabad is hereby directed to dispose of the petition to be filed by the petitioner under Section 70 (2) Cr.P.C. on the same day in accordance with law. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
