The present writ petition came to be filed seeking to declare the action of the 4th respondent, in deleting the name of the petitioner and mutating the names of the respondents 5 to 9 for the land admeasuring Ac.2.13 cents in sy.No.1015/1 of Paturu Village, Nandalur Mandal, Y.S.R. District, without issuing any notice to the petitioner as the said land is the ancestral property of the petitioner, as illegal and arbitrary. The grievance of the petitioner appears to be that the 4th respondent deleted the name of the petitioner and recorded the names of the respondents 5 to 9 in the revenue records in respect of the subject land of the petitioner, without giving any notice to the petitioner.
As can be seen from the record, it is clear that the petitioner has to prefer an appeal before the Revenue Divisional Officer questioning the action of the Tahsildar in deleting his name from the revenue records. Having regard to the facts and circumstances of the case, the writ petition is disposed of giving liberty to the petitioner to avail the remedy available under law. However, if any appeal, is filed by the petitioner, the same shall be disposed of in accordance with law, after giving the reasonable opportunity of hearing to the petitioner and all concerned, as early as possible preferably, within a period of two to four months from the date of receipt of copy of this order, as the petitioner is a senior citizen.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
