THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.16509 of 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This writ petition is filed seeking directions by way of Mandamus to set aside the e-auction sale notice dated 28.04.2015 and the subsequent corrigendum dated 04.05.2015, fixing the date of auction as 12.06.2015 for sale of the secured items, in exercise of powers under the provisions of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. When the matter is called for hearing, it is submitted by the learned counsel for petitioner and also Sri Maruthi Jadhav, learned Advocate representing Sri B.S.Prasad, Standing Counsel appearing for respondent No.1-State Bank of India, that no e-auction has taken place on 12.06.
2015 for want of bidders. Learned counsel for respondent No.1 further submitted that if re-auction is to be conducted, the Bank will issue fresh notice in accordance with law. In view of the submission of the learned counsel for respondent No.1Bank, the learned counsel for petitioner requested to dispose of the matter by recording the said submission.
Hence, recording the submission made by the learned counsel for respondent No.1-Bank, the writ petition stands disposed of. However, it is made clear that if any further notice is issued, the petitioner is at liberty to pursue the remedies available under law. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand
closed.
