THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31817 OF 2017 O R D E R:
The case of the petitioner as made out in the Writ Petition is that though he has not been shown as an accused in relation to F.I.R No.202 of 2017 of Arilova Police Station for the offences, under Sections 406, 409, 465, 466, 468, 471, 420, 120b I.P.C., is being forced to sign certain papers under the threat of using third degree against the petitioner.
Learned counsel for the petitioner submits that the petitioner is only a driver of one Gedala Laxmi Ganesh and he is nothing to do with the offences alleged against the said individual. In those circumstances, complaining harassment in the hands of the police, petitioner filed the present Writ Petition.
Learned Government Pleader for Home (AP) on instructions submit that there is a prima facie material, wherein the petitioner had received certain gifts from the accused and investigation is in progress, only in connection with the investigation petitioner is being called and the allegations of using any third degree is denied. Considering the respective submissions, by making it clear that the petitioner shall not be unnecessarily harassed, the Writ Petition is disposed of. However, the respondent authorities may question the petitioner in connection with the Crime No.202 of 2017 of Arilova P.S. duly following the procedure prescribed under the Criminal Procedure Code. No order as to costs.
Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
