Gorla Yadaiah Yadav v. The State Of Telangana

HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33530 of 2018 ORDER:

The present writ petition came to be filed seeking the following relief:

" To declare the action of respondents in not conducting the survey of petitioner's land in Sy.No.156 (Known as Ragadi Polam Tangella Gadda), admeasuring Ac.5-19 gts., situated at Kacharam village, Shamshabad Mandal, Ranga Reddy District, and without considering the petitioner's representation dt.02.04.2018 as illegal, arbitrary, violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondent No.3 to 5 to conduct survey and fix the boundaries in respect of petitioner's land in Sy.No.156 (Known as Ragadi Polam Tangella Gadda), admeasuring Ac.5-19 gts., situated at Kacharam villag,e Shamshabad Mandal, Ranga Reddy District, forthwith."

When the matter is taken up for hearing, the learned counsel for the petitioner would submit that though survey of the subject land was conducted, till date no report is issued to the petitioner.

Learned Government Pleader would submit that if survey is already conducted, a direction may be issued to the concerned authority to issue the report.

Having regard to the above, the writ petition is disposed of at the admission stage, directing the 4th respondent to communicate a copy of the survey report, said to have been conducted, in respect of the land in Sy.No.156 (Known as Ragadi Polam Tangella Gadda), admeasuring Ac.5-19 gts., situated at Kacharam village, Shamshabad Mandal, Ranga Reddy District, to the petitioner, within a period of ten to twelve days from today, if survey is already conducted. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
