HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.45082 OF 2016 ORDER:

The case of the petitioner is that he was appointed as an Attender with the respondents and he has rendered more than three decades of service and his services were regularised vide proceedings dated 25.11.2004. His grievance is that his services ought to have been regularised with effect from 14.10.1991 i.e., on completion of ten years of service.

Learned counsel appearing for the parties had submitted that the issue raised in this writ petition is squarely covered by the order of this Court in W.P.No.13791 of 2019 dated 08.07.2019. Therefore, for the reasons alike, this writ petition is disposed of directing the petitioner to submit a representation afresh to the respondents seeking regularisation of his services from the date of completion of 10 years of service i.e., with effect from 14.10.1991, within a period of two weeks from the date of receipt of a copy of this order, and upon such representation being received, the respondents shall consider the same strictly by duly taking into account the judgment rendered by the Hon'ble Supreme Court in Civil Appeal No.6318 of 2015 (arising out of SLP(C) No.12432/2014) dated 17.08.2015 in B.Srinivasulu vs. Nellore Municipal Corporation and pass appropriate orders in accordance with law, in another eight weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. ______________________________ ABHINAND KUMAR SHAVILI, J 17th September, 2019 v v
