HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE NO.1377 OF 2016 ORDER:

This revision is filed by the petitioner-accused aggrieved by the order dated 15.3.2016 passed by the Judicial Magistrate of First Class, Special Mobile, Nellore, in Crl.M.P.No.93 of 2016 in C.C.No.80 of 2014.

The petitioner filed the above Crl.M.P. seeking to recall NBWs issued against him on 12.2.2016. The trial Court dismissed the said application. Aggrieved by the same, the present revision case is filed. Heard and perused the material available on record. The learned Counsel for the petitioner submitted that the petitioner could not attend before the Court below on 12.2.2016 as he was hospitalized due to accident and his absence was not intentional and therefore, the NBWs issued against the petitioner may be recalled.

Having regard to the facts and circumstances of the case, the petitioner is directed to appear before the trial Court and file an application to recall NBWs issued against him. On such application being filed, the trial Court is directed to recall NBWs issued against the petitioner on the same day. Further, the petitioner is directed to appear before the trial Court regularly in future on every date of hearing of the above C.C. till its disposal.

With the above direction, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
