No representation on behalf of the petitioner. Even on earlier occasion also, there was no representation from the petitioner. Sri S.Ganesh, learned Assistant Public Prosecutor representing the respondent No.1/ State as well as Sri C.Hari Preeth, learned counsel for the respondent No.2 are present. 02.

This Criminal Revision Case is filed aggrieved by Order dated 02.05.2011 in M.C.No.4 of 2010 on the file of the learned Family Court, Secunderabad, wherein the petition is partly allowed directing the petitioner to pay monthly maintenance of Rs.8,000/- to the respondent No.2. It appears that this Order has been passed on 02.05.2011 i.e., about 11 years ago.

The petitioner has approached this Court with a prayer that the maintenance granted by the trial Court in M.C.No.04 of 2010 is excessive. May be the petitioner is correct, after taking into consideration the circumstance existed in the

year 2011. But, even after passing of 11 years of this Order, the cause of action does not survive to the petitioner to submit that the amounts granted were excessive. Even the source of income of the petitioner must be enhanced from the date of order of the trial Court.

Learned counsel for the respondent No.2 Sri C.Hari Preeth, reported that sole petitioner by name Sri M.Ranga Reddy, who filed this petition, is no more.

Taking into consideration all the facts and circumstances, this Court is of the opinion that since the petitioner has no cause of action, this Criminal Revision Case is liable to be dismissed.

Accordingly, this Criminal Revision Case is dismissed. No order as to costs.

As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
