HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No. 5195 of 2016 ORDER:

The inaction of respondent No.4, in filing charge sheet in FIR No.77 of 2013, is questioned in the Writ Petition as illegal and arbitrary.

Petitioner states that her husband and in-laws possess agricultural land admeasuring Ac.8.00 gts. in Sy.Nos.3/3, 4/4 and 4/5 situated at Rangapuram Village, Paloncha Mandal, Khammam District, and raised 250 mango trees, out of which, 60 trees were spoiled and the remaining are ready to harvest; one Sri Maloth Tarachand and his followers trespassed into the subject lands and threatened to kill if they enter into the said lands; and hence the complaint.

Heard the learned Counsel for the petitioner and learned Assistant Government Pleader for Home (TG). Respondent No.4, in his counter, would submit that, based on the contents of the above complaint, a case in Crime No.77 of 2013, under Sections 420, 447, 468, 427, 471, 506 and 509 IPC, was registered on the file of Paloncha Rural Police Station, Khammam District, on 16.05.2013 and investigation was taken up.

Learned Counsel for respondent No.5 submits that the petitioner is not entitled to police protection to protect

her lands as there is no order by any Court to grant the said relief, but, at best, respondent No.4 may be directed to complete investigation in FIR.No.77 of 2013.

The relief claimed by the petitioner is only to expedite investigation in FIR.No.77 of pending before respondent No.4. The investigation in FIR.No.77 of 2013 has been pending since 16.05.2013, respondent No.4 is directed to complete investigation and file charge sheet expeditiously.

With the above observation, the Writ Petition stands disposed of.

Miscellaneous Petitions pending, if any, shall also stand closed.
