Heard the learned Assistant Government Pleader for Home for respondents 1 to 5.

The petitioner complains against the respondent No.4 calling the petitioner to II Town Police Station and threatening the petitioner to hand over possession of plot No.9, admeasuring 200 square yards in Sy.No.31 at Vidyanagar, Adilabad, to respondent Nos.6 to 8 etc., as illegal, arbitrary and unconstitutional.

Respondent No.4 filed counter-affidavit explaining the circumstances leading to skirmish between the petitioner and unofficial respondents and what he has done on receiving information and on the alleged interference with civil dispute or threatening to hand over possession, the counteraffidavit reads thus : "It is respectfully submitted that at no point of time, this respondent asked the petitioner to hand over their property to the unofficial respondents 6 to 8 herein nor assist the respondents 6 to 8 while demolishing the compound wall in the subject property in question. In this regard, it is humbly submitted that on receipt of a phone call that the petitioner herein as well as the unofficial respondents herein are quarrelling with each other about the subject property and on receipt of the same, to know the veracity of the phone call, this respondent sent a beat constable to the subject property in question. It is humbly submitted that this respondent never interfered with the civil disputes much less the dispute of the petitioner herein."

The statement of the 4th respondent is placed on record and the Writ Petition is disposed of accordingly. No order as to costs. 6.
