HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.37259 OF 2012

ORDER

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the 3rd respondent in interfering with the civil disputes between the petitioners and 4th respondent without having any jurisdiction as arbitrary and illegal.

Counter-affidavit has been filed by the Sub Inspector of Police, Madakasira Police Station, Anantapur District, paragraph No.5 of which reads as under:

"In reply to para No.5 of the affidavit, it is respectfully submitted that the allegation of the petitioner that the 4th respondent is approaching this respondent frequently, requesting to settle the matter and in turn, this respondent again on 26.11.2012 called her to the police station and directed her to settle the dispute with the 4th respondent and conducted a panchayat in the police station is utterly false, baseless and hence the same is denied. The allegation of the petitioner that this respondent absolutely acting as per the instructions of the local political ruling leaders since the 4th respondent belongs to ruling party member, she has been trying to interfere with the support of the police and the present political leaders is also false and hence the same is denied."

While referring to the above said paragraph, it is submitted by the learned counsel for the petitioner that the same may be placed on record and the writ petition be disposed of.

In view of the same, this Writ Petition is disposed of placing on record the averments made at paragraph No.5 of the counter-affidavit of the respondents. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
