THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41699 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondent in not allowing to submit his explanation, as illegal and arbitrary and to consequently direct the respondent to issue passport to the petitioner and to issue necessary orders in this regard.

Heard and perused the material available on record. The grievance of the petitioner is that when the petitioner applied for passports for him and his wife before the respondent, on 19.01.2016 the respondent sent a letter informing that one criminal case has been registered against the petitioner and asked the petitioner to give explanation within a period of 21 days and that when the petitioner approached the concerned officer on 13.02.2016, the security persons did not allow him to go inside.

Considering the grievance of the petitioner, the writ petition is disposed of with the following direction:

The petitioner is directed to give a detailed representation to the notice issued by the respondent, dated 19.01.2016, through Registered Post with Acknowledgement Due and on receipt of the said representation, the respondent is directed to dispose of the same, in accordance with law, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of the said representation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO, J Date: 5th December, 2016 KL
