HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.16371 of 2017 O R D E R:

This writ petition is filed challenging the impugned proceedings dated 07.04.2017 passed by the 2nd respondent, issuing notice to the petitioner while enclosing the copy of the enquiry report and its enclosures of the Regional Joint Director of Collegiate Education, Rajahmundry, to submit his explanation on the allegations, which were held to be proved in the enquiry, within 15 days from the date of receipt of the proceedings.

2. Learned senior counsel appearing for the petitioner submits that the 2nd respondent has already made up his mind and there is nothing remains to take a decision even after submission of the explanation by the petitioner.

3. A reading of the impugned order clearly shows that it is a show cause notice and the petitioner is given liberty, before the 2nd respondent wants to take a decision on the basis of the findings recorded by the Enquiry Officer.

4. In the circumstances, the writ petition is disposed of giving liberty to the petitioner to submit his explanation within 15 days from the date of receipt of a copy of this order and on receipt of the same, the 2nd respondent shall pass appropriate orders, in accordance with law, by taking into consideration of the facts, without being influenced by the observations made by the Enquiry Officer in the enquiry report. No order as to costs. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
