O R D E R
The Criminal Petition is filed under Section 482 of BNSS praying this Court to grant pre-arrest bail to the petitioneraccused No.11 in Crime No.1082 of 2021 before the L.B.Nagar L And O Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 307, 341, 504 and 506 read with 34 of IPC.

The brief facts of the case are that, on 08.09.2021, the defacto complainant lodged a report before the police stating that on
07.09.2021 at about 23:10 hrs, his friend informed him that his brother Devender had sustained severe injuries and was being taken to Health Care Hospital. On reaching the hospital, he found Devender with bleeding injuries to his stomach and head. Subsequently, the complainant came to know that accused Nos.1 to 8 had attacked Devender with a broken beer bottle, with an intention to kill him, causing grievous injuries. In the said incident, some others were also injured by the accused. During investigation, the petitioner was arrayed as Accused No.11. The crime was registered in 2021, and the petitioner was shown as absconding. A charge sheet was filed on 19.09.2022, and a supplementary charge sheet was later filed in S.C. No.450 of 2022.

Heard Sri Chinthamanu Ramanjaneyulu, learned counsel for the petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State. 4.
Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and his name was not mentioned in the FIR or in the original complaint filed before the police, and he has been falsely implicated during the course of investigation. He further submitted that there are no specific
allegations against the petitioner, the investigation has been completed, and the charge sheet has already been filed in S.C. No.450 of 2022. Hence, custodial interrogation of the petitioner is not required. Therefore, he prayed the Court to grant anticipatory bail to the petitioner by allowing this criminal petition. 5.
Notice was served on the de‐facto complainant, but none appeared on his behalf.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner were grave in nature and that due to the involvement of the petitioner, the Investigating Officer was compelled to file a supplementary charge sheet, and custodial interrogation of the petitioner is necessary for further investigation. Hence, he prayed the Court to dismiss the criminal petition.

Upon considering the rival submissions and perusing the material on record, it is noted that the crime was registered in the year 2021 and the charge sheet was filed in 2022, numbered as S.C. No.450 of 2022 and there are no specific allegations against the petitioner. In view of these circumstances, this Court deems it
fit to grant pre‐arrest bail to the petitioner, subject to compliance with the following conditions:
i.
The petitioner shall surrender before the Station House Officer, L.B. Nagar Police Station, Rachakonda Commissionerate within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
