THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.21173 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.4 in issuing the endorsement, dated 15.06.2016, stating that as per the entry in Khasra Pahani, father of the petitioner sold the lands in Survey Nos.270 to 272 situated at Pothireddypally Village, Thimmajipet Mandal, Mahabubnagar District, to third parties, and proceeding further to pay compensation in respect of the subject lands to unofficial respondents by ignoring the pendency of revision and civil Suit, as illegal and arbitrary.

The case of the petitioner is that his father was the pattadar of lands admeasuring Ac.7-32 guntas, Ac.13-32 guntas and Ac.8-24 guntas covered by Survey Nos.270, 271 and 272, respectively, situated at Pothireddypally Village, Thimmajipet Mandal, Mahabubnagar District, and his name was entered in the Khasra Pahani issued for the year 1954-55. After his death, he along with his brothers succeeded the subject lands and their names were recorded in the revenue records as pattadars and possessors of the subject lands. He filed O.S.No.63 of 2015 on the file of Senior Civil Judge, Mahabubnagar, seeking partition among the brothers. While so, the

unofficial respondents got entered their names in the revenue records and as such, the petitioner filed revision, under Section 9 of the A.P. Rights in Land and Pattadar Pass Books Act, 1971, before respondent No.2, and notices were issued to him and the unofficial respondents. As the respondent authorities are trying to acquire the subject lands by virtue of G.O.Ms.No.123, dated 30.07.2015, he made an application to respondent No.4 claiming compensation, but the same was rejected. Hence, the present Writ Petition is filed.

Heard learned counsel for the petitioner, learned Advocate General and learned Government Pleader for Land Acquisition.

Learned Government Pleader for Land Acquisition, on written instructions, submits that in view of the dispute raised by the petitioner, the land acquisition authorities stopped payment of compensation in respect of the subject lands.

Recording the same, the Writ Petition is disposed of and respondent No.2 is directed to dispose of the revision filed by the petitioner, after issuing notice to the petitioner and the affected parties, and pass orders in accordance with law.

Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
