HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18895 OF 2016 ORDER:

The case of the petitioner is that he is an Ex-service man and was sanctioned a house site patta under Ex-service Men Quota bearing H.S.No.A1421/88, Vacant site Plot No.2C, 2nd Ward, Survey No.62/2, Military Colony, Near Kadiri Raod, Bandameedakammapalle Village, Madanapalle Mandal, Chittoor District vide proceedings No.H.No.2B/1400, Roc.A.1421/88 dated 08.07.1990. While so, when petitioner intended to alienate the said property granted to him, he made an application on 17.04.2016 to the 2nd respondent seeking issuance of No Objection Certificate (NOC). Since no action has been initiated by the 2nd respondent, the 3rd respondent is not receiving and registering the document presented by the petitioner on the ground that NOC has not been issued. Aggrieved by the action of the 4th respondent, the present writ petition is filed.

Heard learned counsel for the petitioner.

It is stated that the Government has recently issued G.O.Ms.No.279 dated 04.07.2016 which states lands assigned to Ex-serviceman can be alienated after expiry of the period of ten years.

In view of the same, the 3rd respondent is directed to consider the case of the petitioner for receiving the document and registering the same in terms of G.O.Ms.No.279, dated 04.07.2016 on being satisfied with the genuineness of patta issued to the petitioner if the same are in order as per the provisions of the Indian Stamps and Registration Act and the Rules made

thereunder.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-07-2016 Note:
