HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.1413 of 2016 O R D E R :

This criminal petition is filed by petitioner - accused No.1, under section 438 Cr.P.C., seeking anticipatory bail in Crime No.22 of 2016 of Nalgonda I Town Police Station, registered for the offence punishable under Sections 406, 409, 420 I.P.C. read with Section 76 of Chit Funds Act, 1982 and Section 5 of A.P. Protection of Depositors of Financial Establishment Act, 1999.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and perused the material available on record.

The de facto-complainant in the complaint stated that she has joined in Sri Sai Chit Fund & Finance at Nalgonda in the month of January, 2012 in a chit group of LF-IX for Rs.2,50,000/- and paid every month Rs.10,000/-. Total 25 months' chit amount of Rs.2,50,000/- was paid. Later in the month of January, 2014, she again joined in the Chit group of SF-II for Rs.5,00,000/- and paid every month Rs.20,000/-. Total 24 months' chit amount of Rs.4,80,000/- was paid. After that in the month of June, 2015, she again joined in the chit group of SSF-VIII for Rs.5,00,000/-and paid every month Rs.20,000/-. Total 7 months' chit amount of Rs.1,40,000/- was paid. The

petitioner, partner of Sri Sai Chit Funds & finance at Nalgonda was physically came to her house at Hyderabad and collected every month the above chit amount. On 12-01-2016, when she was watching TV, she noticed that Nalgonda Sri Sai Chit Fund & Finance was closed and partners of the said chit fund were escaped with the chit subscribers' money. Thus, they cheated and escaped with her total chit amount of Rs.8,70,000/-. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to petitioner - accused No.1 at this stage.
