ORDER :

The petitioner is a Technical Assistant and vide proceedings dated 28.10.2015 a show cause notice was issued to the petitioner alleging that he has committed certain financial irregularities, calling upon his explanation. Pending enquiry, his services as Technical Assistant are temporarily withdrawn (suspension). The petitioner challenges the said order to the extent of withdrawing his services temporarily.

2. On perusal of the proceedings dated 28.10.2015, it appears that in the report of the Assistant Project Director, Chintalapudi dated 16.10.2015 certain financial irregularities were noticed. Thus, when serious allegations of financial irregularities are noticed, in the public interest the person against whom such allegations are leveled should not be allowed to be continued in the post. Whether there is any merit in the allegations is a matter for consideration during the course of disciplinary action. I therefore, do not see any illegality or irregularity in the decision of the competent authority in withdrawing the services of the petitioner temporarily (suspension).

Thus in view of the Human Resources Policy and circulars issued by the competent authority on regulation of services of technical Assistant, the competent authority is directed to complete the enquiry and finalize the proceedings, as expeditiously as possible preferably within a period of thirty (30) days from the date of receipt of copy of this order. The petitioner shall also cooperate in early disposal of the enquiry.

3. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
