HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45738 of 2016 ORDER:
The present writ petition is filed by the petitioners seeking to declare the action of the 4th respondent being Sub-Inspector of the 3rd respondent office, is interfering with the personal life and liberty of the petitioners and abusing them by using filthy language by humiliating the 1st petitioner an also threatening the petitioners with dire consequences, as illegal and arbitrary and consequently direct the 4th respondent to follow the procedure in the event of any case registered against the petitioners. Heard and perused the material available on record. There disputes between the 1st petitioner and his wife. Since the wife of the 1st petitioner approached the 4th respondent, the 4th respondent is calling the petitioners to the police station and abusing them in filthy language and threatening them with dire consequences, in case they did not settle the issue with the wife of the 1st petitioner, without there being any case pending against them.
Learned Assistant Government Pleader for Home submitted that the respondent police are not calling the petitioners to the police station and they are not interfering with the life and liberty of the petitioners, and in case any case is filed, they would follow the due procedure. Recording the above said submission of the learned Assistant Government Pleader, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J December 27, 2016.
