THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36098 of 2013 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.35 of Chandaluru Village, Darsi Mandal in Prakasam District. The Enforcement Deputy Tahsildar, Darsi, inspected the shop on 27.06.2013 and finding some variation in the stock, he submitted a report. Basing on the said report, the second respondent issued a show cause notice on 28.10.2013 by framing 13 charges against the petitioner. The authorisation of the petitioner was cancelled by order dated 18.11.2013 by recording that the petitioner had not submitted her explanation. Challenging the same, the petitioner preferred an appeal along with a stay application before the first respondent on 02.12.2013 and when the same was not disposed of, the present Writ Petition was filed.

This Court, while ordering notice before admission, granted interim direction directing respondent Nos.2 and 3 to supply the essential commodities to the petitioner, as a result of which, the petitioner has been continuing as on today. Since the Writ Petition is filed challenging the non-disposal of appeal by the first respondent, this Court deems it just and necessary to dispose of the Writ Petition by directing the first respondent to consider and dispose of the appeal of the petitioner dated 02.12.2013 in accordance with law by giving due opportunity to the petitioner, and pass final orders thereon within a period of three months from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
